Welcome to Andrew Whittington Fine Art. By accessing or purchasing from andrewwhittingtonfineart.com, you agree to the following Terms of Service. Please read them carefully before using the website or placing an order.
1. General Conditions
You must not use this site or its content for any unlawful or unauthorized purpose.
You agree not to reproduce, copy, sell, resell, or exploit any portion of the website or artwork without written permission from me.
I reserve the right to refuse service to anyone for any reason at any time.
2. Accuracy of Information
I do my best to display accurate information, including pricing, availability, product descriptions, and images.
However, errors may occur. I reserve the right to correct inaccuracies and update information at any time without prior notice, including after you have placed an order.
3. Artwork & Product Information
All artwork — including originals, limited-edition prints, open editions, and made-to-order prints — is created or prepared with care.
Colours may vary slightly between your screen and the physical piece; this is not a defect.
Sizes listed are approximate and may vary slightly due to standard printing, stretching, or framing tolerances.
4. Prices & Payments
Prices for artwork are listed in Canadian dollars (CAD) unless otherwise stated.
I reserve the right to update pricing at any time.
By completing a purchase, you authorize Shopify Payments (or your selected payment method) to charge your payment method for the total order amount, including applicable taxes and shipping.
5. Shipping
Shipping times are estimates and may vary due to carrier delays, weather, or other factors outside my control.
Once an order is shipped, responsibility for delivery is transferred to the carrier.

6. Refunds, Returns & Exchanges
All sales are final.
This includes original paintings, prints, and custom commissions.
I do not accept returns, exchanges, or cancellations due to buyer’s remorse, size mismatches, or colour variations.
If your artwork arrives damaged, or if there is a fulfillment issue, I will work with you to resolve it.
Please submit your request through my contact page within 48 hours of delivery.
7. Commissions
Commissioned artwork requires a non-refundable deposit.
Once work has begun, the project cannot be cancelled.
Any timelines provided for commissions are estimates and may change depending on the complexity of the piece.
8. Prohibited Uses
You may not use this site or its content:
• For any unlawful purpose
• To violate any laws or regulations
• To infringe on intellectual property rights
• To harass, abuse, insult, harm, or discriminate
• To upload malicious code, viruses, or harmful scripts
• To collect personal information about others
Violation of these terms may result in termination of access to the site.
9. Intellectual Property
All artwork, images, designs, and content on this website are protected by copyright.
You may not reproduce, print, resell, or distribute any artwork without my explicit written permission.
10. Third-Party Services
Some services (such as payment processors, shipping carriers, or print fulfillment partners) operate independently.
Your interactions with them are governed by their terms and privacy policies.
11. Limitation of Liability
I am not liable for any damages, losses, or claims resulting from your use of this site, your inability to use it, or any errors or omissions in the content or services provided.
This includes indirect or consequential damages of any kind.
